Terms of Website Use
Last updated: 18 September 2026
Who we are
This website, www.obsidianarctraining.com, is operated by Obsidian Arc Training Ltd (“we”, “us”, “our”), a company registered in England and Wales under company number 17401446, with its registered office at 14 Alum Way, Fareham, England, PO16 8RJ.
You can contact us at [email protected].
We are a training provider. We are a separate legal entity from Obsidian Arc Ltd (company number 16436270) and from any other company using the Obsidian Arc name. Nothing on this site should be read as an offer, representation or commitment by any other company.
These terms
By using this website you agree to these terms. If you do not agree to them, please do not use the site.
We may change these terms at any time by amending this page. The date at the head of this document tells you when it was last changed. Please check it from time to time. Continuing to use the site after a change means you accept it.
These terms cover use of the website only. If you book a course with us, the contract between us is governed by our Booking, Payment and Cancellation Terms, not by this document. If there is a conflict between the two, the Booking Terms take precedence in relation to that booking.
What this website is for
This site describes training and qualifications we offer or intend to offer. It is provided for general information.
Information on this site is not advice. Nothing on this site is legal advice, investigative advice, operational advice, or advice on the lawfulness of any particular research activity. Open source intelligence work engages a body of law
— including the Data Protection Act 2018, the Computer Misuse Act 1990, the Investigatory Powers Act 2016 and the Regulation of Investigatory Powers Act 2000 — that applies differently to different organisations and different purposes. If you need to know whether a particular activity is lawful for you, take your own advice.
We make no representation that the content of this site is suitable for, or available in, any jurisdiction other than the United Kingdom.
Qualification and regulatory statements
Where this site refers to a regulated qualification, it refers to the NOCN Level 3 Award in Open Source Intelligence, qualification number 610/7695/8, which is regulated by Ofqual and has been on the register of regulated qualifications since 1 August 2026.
The qualification is owned and awarded by NOCN. We are not an awarding organisation. We do not award, issue or certificate the qualification, and we are not a regulator.
Where we describe our own status as a delivery centre, that description is accurate at the date shown on the relevant page. Our status may change. You should not rely on any statement on this site about our centre status without confirming the current position with us in writing.
We are not responsible for the content of NOCN’s website, Ofqual’s register, or any other third party site, even where we link to it.
Accuracy, availability and change
We take care over what we publish, but:
- Content may be changed at any time without notice.
- We do not warrant that the site, or any content on it, is accurate, complete, current or free from error.
- We do not guarantee that the site will be available uninterrupted. We may suspend, withdraw or restrict all or part of it for business or operational reasons, and we will try to give reasonable notice where we can.
- Course dates, formats, fees, locations and content shown on the site are indicative and are subject to confirmation at the point of booking.
You are responsible for making sure that everyone who accesses the site through your connection is aware of these terms.
Intellectual property
We own or are licensed to use all intellectual property rights in this site and in the material published on it. Those works are protected by copyright and other laws.
You may print one copy and download extracts of any page for your own personal use or for the internal use of your organisation in evaluating our services. You may not:
- modify paper or digital copies of anything you have printed or downloaded;
- use any illustration, photograph, video, audio or graphic separately from the text that accompanies it;
- use any part of this site for commercial purposes without a licence from us;
- remove or alter any copyright, trade mark or other proprietary notice.
Our name, logo and brandmark are our property. Third party trade marks appearing on this site are acknowledged as belonging to their owners, and their appearance does not imply any endorsement, partnership or approval.
Acceptable use
You must not:
- use the site in any way that breaches any applicable law or regulation, or for any unlawful or fraudulent purpose;
- use the site to collect, scrape or harvest personal data, or to compile information about our staff, learners or clients;
- attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it;
- introduce any virus, trojan, worm, logic bomb or other material which is malicious or technologically harmful;
- attack the site via a denial-of-service attack;
- reproduce, duplicate, copy or resell any part of the site contrary to these terms.
We take the point seriously in our field, so we will say it plainly: the fact that we teach open source research techniques does not make it acceptable to use them against us or our people. We will report any breach of this section to the relevant law enforcement authority and will co-operate with that authority, including by disclosing your identity where we are lawfully able to do so. A breach is a criminal offence under the Computer Misuse Act 1990.
Links, third party content and user submissions
Links from this site to other sites are provided for information. We do not endorse them and we accept no responsibility for their content or for any loss arising from your use of them.
You may not link to this site in any way that suggests any form of association, approval or endorsement on our part that does not exist, or frame it on any other site, without our written permission. We may withdraw linking permission at any time.
If you send us material through this site — an enquiry, a form submission, a document — you confirm that you are entitled to send it, that it is accurate, and that it does not infringe anyone’s rights. Do not send us confidential, classified, protectively marked or operationally sensitive material through the website. If you need to send us something sensitive, contact us first and we will agree a secure route.
Our liability
Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot lawfully be excluded or limited.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Nothing in these terms affects your statutory rights.
If you are a business user, we exclude all implied conditions, warranties, representations and other terms to the fullest extent permitted by law, and we will not be liable to you for any loss of profit, loss of business, loss of anticipated savings, business interruption, loss of goodwill, or any indirect or consequential loss arising out of your use of, or inability to use, this site.
We are not liable for any loss or damage caused by a virus or other technologically harmful material that infects your equipment because of your use of this site or of any content on it. You are responsible for configuring your own information technology and platform to access the site, and for using your own virus protection.
Data protection and cookies
How we handle personal information is set out in our Privacy Policy. How we use cookies and similar technologies is set out in our Cookie Policy. Both form part of these terms.
Suspension of access
We may suspend or withdraw your access to the site, without notice, if you breach these terms.
Law and jurisdiction
These terms, their subject matter and their formation are governed by the law of England and Wales.
If you are a consumer, you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction, and that if you live in Scotland or Northern Ireland you may also bring proceedings in your own jurisdiction.
If you are a business, the courts of England and Wales have exclusive jurisdiction.
